Moller Club Terms and conditions
1. Definitions
1.1. Moller Auto – Moller Auto Baltic SIA, registration number 40203251094, legal address S.Eizenšteina iela 10, Rīga, LV-1079, Latvia.
1.2. Moller Club programme – a loyalty programme created and maintained by Moller Auto
1.3. Moller Club Missions - a task or set of activities designed to engage Moller Club participants in experiences that enhance their automotive knowledge, encourage safe driving, or improve vehicle maintenance. Missions are interactive challenges that can be completed by following specific steps provided within the Moller Club app. Each mission offers a unique reward upon successful completion.
1.4. Moller Club rewards - a reward is a benefit or prize given to participants upon the successful completion of a mission. Rewards can vary in form, including but not limited to:
1.4.1. Products: Physical items such as car accessories, branded merchandise, or maintenance products.
1.4.2. Services: Discounts or complimentary services, such as car washes, servicing, or diagnostics at Moller Auto or partner locations.
1.4.3. Experiences: Exclusive access to events, test drives, or special offers from Moller Auto or its partners.
1.5. Rewards are designed to enhance the participant’s experience in the Moller Club and may be tied to automotive-related activities, partner services, or other lifestyle benefits.
1.6. Moller Club terms and conditions - these terms and conditions, which determine the operational conditions and procedures of the Moller Club loyalty programme and are binding and applicable to members and partners of the Moller Club programme. Any concepts not defined within these terms and conditions shall be interpreted in accordance with the regulations of the relevant regulatory legal acts.
1.7. Moller Club mobile application – (also Moller Club app) a mobile application created and maintained by Moller Auto, designed for use on mobile devices. Moller Club members can join the Moller Club loyalty programme only using this application, see their missions and receive their rewards.
1.8. Moller Club member - an individual who has applied for the Moller Club programme and whose membership in the Moller Club loyalty programme has been approved by Moller Auto.
1.9. Registration form - an online application form that is filled in Moller Club mobile application and expresses the individual’s desire to participate in the Moller Club programme.
1.10. Moller Club account - an account created and approved by the Moller Club member based on their voluntarily provided personal data, and in which the members fulfilled missions and rewards are stored.
1.11. Partner - partner of the Moller Club programme that has engaged in a co-operative relationship with Moller Auto. This co-operation may involve member missions and rewards, or other forms of collaboration between partner and Moller Auto for the purpose of Moller Club loyalty programme. Each partner retains the right to set individual co-operation regulations and policies for missions and rewards.
2. Moller Club account and membership
2.1. Individuals who have completed the registration form and have reached the age of 18 (eighteen) can independently join the Moller Club loyalty programme.
2.2. To participate in the Moller Club programme, the person must have a unique e-mail address that can be registered for only one Moller Club account.
2.3. The Moller Club member shall ensure the accuracy of data registered in the Moller Club account and shall take active steps to correct the data whenever data is incorrect or outdated. The Moller Club member shall keep all account credentials strictly confidential and not accessible to third parties.
2.4. Moller Auto reserves the right to retroactively and without notice correct the Moller Club member's account in case of incorrect data entered due to error or other reason.
2.5. By joining the Moller Club loyalty programme, the Moller Club member agrees to the Moller Club terms and conditions and all changes that will be made to them. Moller Auto reserves the right to unilaterally change and update air Moller Club terms and conditions.
2.6. After joining the Moller Club programme, the Moller Club member gets informed via e-mail about the Moller Club programme and how to use it.
2.7. As Moller Club Rewards have a personal nature, in the event of the programme member's death, the inheritance of the Moller Club rewards accumulated by this person is not allowed.
2.8. During the use of the Moller Club account, the Moller Club member is responsible for maintaining the security and safety of the communication means, systems, and established communication channels.
2.9. In the event of an unauthorized use of the member's Moller Club account information, Moller Club member must immediately contact and inform the Moller Club member support. The Moller Club member remains accountable for any data misuse until the Moller Club member support is informed of the situation.
2.10. Moller Auto reserves the right to reject participation applications in the Moller Club programme without providing a reason or prior notification to the Moller Club member.
3. Moller Club Missions
3.1. Mission Types - missions in the Moller Club app are diverse and tailored to the user's profile. They are designed to engage participants in activities related to car maintenance, safe driving, and other automotive-related tasks.
3.2. Personalization - missions may be personalized based on the participant’s preferences, car ownership history, and activity level within the Moller Club app.
3.3. Mission Completion - each mission will have specific requirements for completion. Users must follow the provided guidelines to successfully complete a mission and claim the reward.
3.4. Moller Club is not responsible for any risks or damages arising from the completion of missions. Participants should take all necessary precautions while carrying out any mission tasks.
3.5. Moller Club reserves the right to modify, cancel, or terminate any mission at its discretion. Participants will be notified of significant changes to mission terms or conditions.
3.6. Participants must engage in missions honestly and in good faith. Any attempts to manipulate, cheat, or falsely complete missions will result in disqualification from the mission and potentially the program as a whole.
3.7. Moller Club may collect and process data related to mission participation, including personal information, in accordance with its privacy policy and applicable laws.
3.8. By participating in missions, users consent to the collection and use of their data for the purpose of personalizing missions and managing the program.
4. Moller Club Rewards
4.1. Upon successful mission completion, participants will be notified of their reward through the Moller Club app. Rewards may include products, services, or experiences related to Moller Auto, the automotive industry, or our partners. This could include discounts on vehicle maintenance, accessories, or exclusive access to special events and offers from both Moller Auto and our partnering brands.
4.2. Rewards are subject to availability and may change without prior notice. Moller Club reserves the right to substitute rewards of equal or greater value if necessary. In some cases, rewards may be limited to certain geographic locations or partner availability.
4.3. Rewards earned through the Moller Club program are non-transferable and cannot be exchanged for cash, unless explicitly stated. They are intended for personal use only and may not be sold, transferred, or assigned to other participants.
4.4. Rewards offered through our partners are subject to the terms and conditions of the respective partner. Moller Club is not responsible for the fulfillment or any issues arising from partner-provided rewards. Participants should refer to the partner’s terms for further details when claiming such rewards.
4.5. All rewards issued through the Moller Club are valid for a period of 6 months from the date of issuance. After this period, any unused rewards will expire and cannot be redeemed or extended.
5. Programme changes, violation of rules and termination of membership
5.1. The Moller Club member has the right to terminate their membership in the Moller Club programme and close their account at any time by logging in to their profile in the mobile application and following steps described here or by informing the Moller Club member support in writing.
5.2. When terminating membership in the Moller Club programme, acquired Moller Club rewards are not reimbursed or compensated, and they cannot be transferred to other individuals or transferred to another member’s Moller Club account.
5.3. The unauthorized use, sale, exchange, offering for auction, or any other commercial transactions with any Moller Auto and/or Moller Club product and its documents are strictly prohibited, unless expressly permitted. It is strictly prohibited to organize the acquisition and sale of Moller Club rewards, engage in unauthorized reward acquisition, and use rewards and related documents in an unauthorized manner. All such actions are considered as misuse. Such actions are prohibited and may result in the confiscation of rewards and annulation of membership in the Moller Club programme without any compensation and/or reimbursement of losses from Moller Auto.
5.4. Moller Auto reserves the right to terminate the Moller Club member's participation in the Moller Club programme, close the Moller Club member's account without prior notice, and confiscate acquired rewards if the Moller Club member has violated these terms and conditions, provided inaccurate personal data or someone else's data, obtained Moller Club rewards unlawfully and contrary to the principle of good faith (even if there are suspicions of such actions and they have not yet been proven), as well as if the Moller Club member has caused harm to Moller Auto, Moller Club, programme partners, employees, and/or other Moller Club members.
6. Data protection, applicable laws and jurisdiction
6.1. The validity, structure, and execution of these terms and conditions are governed by the laws of the Republic of Latvia, and they fall under the jurisdiction of the courts of the Republic of Latvia. By joining the Moller Club programme, the Moller Club member agrees to submit to the exclusive jurisdiction of Latvian courts.
6.2. If any of these terms and conditions are completely or partially legally invalid, it does not affect the validity of the remaining terms and conditions.
6.3. If these terms and conditions are open to different interpretations in various languages, the English language version shall prevail.
6.4. Moller Auto processes personal data in accordance with applicable European Union and local legal requirements regarding confidentiality and data processing. Detailed information about the processing of personal data is available here.
6.5. For data protection purposes of Moller Club account, Moller Auto has the right to ask additional questions to the programme member and Moller Club account data to verify Moller Club member’s identity before providing any information or taking any actions within the member's Moller Club account.
6.6. Unauthorized attempts to access and use another person's Moller Club account and its data may be subject to penalties, as well as potential legal action. Enforcement authorities, such as local law enforcement agencies and relevant regulatory bodies, may take appropriate actions to investigate and prosecute such unauthorized access and use. Additionally, Moller Auto reserves the right to pursue reputation damage claims against those responsible for unauthorized access or misuse of accounts, seeking appropriate remedies for any harm caused to the company's reputation and any harm imposed on individuals involved as a result.
6.7. Moller Auto reserves the right to apply all sanctions provided in law and justice in the case of the misuse of the Moller Club programme and Moller Club mobile application, as well as violation of these terms and conditions, including the right to block access from specific Internet protocol addresses and block the user's access to these websites and channels.
6.8. Moller Club member is responsible for ensuring the confidentiality of their personal information, including account and password, and for preventing unauthorized access to their computer or other devices to prevent unauthorized access to the Moller Club account.
6.9. Moller Club member agrees to take responsibility for all violations and other actions carried out using their account and password.
6.10. The Moller Club member must take all necessary measures to keep their password confidential and secure. Additionally, they must immediately inform Moller Club member support if there is any reason to believe that their account access information has become known to another person or is being used in an unauthorized manner. Moller Auto is entitled, but not obliged, to suspend or take any other action required and reasonable for the given circumstances to protect the Moller Club member’s account if it is suspected that a third party has gained or might gain access to the Moller Club member’s account.
6.11. Logos, and service marks that are visible in Moller Auto and Moller Club informational materials, communication channels, the Moller Club mobile application, and other channels associated with Moller Auto and Moller Club, belong to Moller Auto or programme partners (as the specific situation requires). Without the written consent of Moller Auto or the involved programme partner to whom the mark or logo belongs, the Moller Club member must not use any mark or logo for any purposes, including but not limited to using them as meta-tags on other web pages or sites. All information and content, including computer programmes accessible or made available via these channels, are protected by copyright.
6.12. Moller Auto does not guarantee or affirm that the content in Moller Auto and Moller Club informational materials, communication channels, the Moller Club mobile application, and other channels associated with Moller Auto and Moller Club is complete and up-to-date. Moller Auto is not obligated to update the content of informational materials, communication channels, and websites and disclaims any responsibility for any inaccuracies, errors, and incompleteness.
6.13. Moller Auto may, at any time, make changes to the content published in Moller Auto and Moller Club informational materials, communication channels, Moller Club mobile application, and other channels associated with Moller Auto and Moller Club without prior notification to Moller Club members, and may make changes or improvements to it.
6.14. The Moller Club member agrees that neither Moller Auto nor programme partners, officials, managers, employees, are responsible for direct or indirect, consequential, punitive losses that may arise due to Moller Auto and/or Moller Club related reasons, even if MollerAuto is informed of the possibility of such losses.
6.15. Moller Auto disclaims responsibility for losses that may hinder the use of the Moller Club account and arise in the case of technical errors, maintenance work, or other actions related to the websites, mobile application, and other channels used by Moller Club.
